Eligibility for Travel

Persons eligible to travel to India and its neighboring countries ("you" or the "Client") on Orient Express Pvt. Ltd. (hereinafter called as "ORIENT EXPRESS PVT. LTD" or "we" ) journeys must have a passport valid from the date of departure for India for a minimum of six months. It is important that the necessary visas, other travel related clearances as prescribed by laws of the country of residence of the client, overseas travel & medical insurance to cover cancellation and curtailment, all medical expenses including evacuation/repatriation, personal baggage, personal liability, death and permanent disability and travel document insurance, are in place/order to be able to undertake the journey.

Scope of Service

ORIENT EXPRESS PVT. LTD is a travel company and its services for the journeys/tours booked by you are limited to the planning and executing the same. While other Service Providers/Suppliers like airlines, hotels, shipping companies, cruise, caravan, coach and other transport services, restaurants (collectively referred to as Service Providers/Suppliers) are important ingredients of the journeys, the Service Providers/Suppliers are independent contractors of ORIENT EXPRESS PVT. LTD and the bookings made through them are undertaken after due care only, but since we do not exercise any control over their functioning, we are not responsible for the quality of products/ services provided by them. In the event of any delay and deficiency in the product/service provided by the Service Providers/Suppliers, ORIENT EXPRESS PVT. LTD is not liable for any such deficiency and the Client cannot seek compensation or claim damages from it. The programmes mentioned in the brochure/website are indicative programmes only and should not be construed as the final itinerary for the destinations mentioned therein. ORIENT EXPRESS PVT. LTD reserves the right to carry out changes in the programmes as deemed necessary by it.

Booking Terms and Conditions

You are required to fill the online booking form after scrutinizing and fully understanding the booking terms & conditions including the price and itinerary. At the time of booking, the Client shall be deemed to have examined and understood all the ingredients of the journey including the status and business of the Service Providers/Suppliers etc. and ORIENT EXPRESS PVT. LTD shall provide all possible assistance in this regard. No person other than the duly authorized personnel of ORIENT EXPRESS PVT. LTD have the authority to alter, amend or waive any stipulation, representation, Terms or Conditions set forth in this document. Any assurance which is contrary to the terms & conditions given herein, shall not bind ORIENT EXPRESS PVT. LTD in any way.

Booking the Journey

The Client shall have to provide the following documents at the time of booking and making the payment for the journey : i. Copy of Passport ii. Copy of relevant Visa

Itinerary

Accommodation and arranged sightseeing schedules are subject to change at any time due to unforeseen circumstances or circumstances beyond ORIENT EXPRESS PVT. LTD's control. Every effort will be made to operate tours as planned, but alterations may occur even after the final itinerary has been issued. ORIENT EXPRESS PVT. LTD also reserves the right to withdraw a tour or any part of it, to make such alterations to the itinerary or the tour inclusions as it deems necessary or desirable, and to pass on to the Client any expenditures or losses caused by delays or events beyond its control. In case of any appreciable variation in the tour price due to these circumstances, ORIENT EXPRESS PVT. LTD reserves the right to make adjustments to the tour costs as necessary.

Price Policy

The price quoted for the journey will be provided for the for the entire travel arrangements subject to availability of space at the time of booking. The quote is subject to change without prior notice. Full Payment is required at the time of making the booking. We offer a 7 day payment option for bonafide Travel Agents booking the online Group/Private tours. Upon passage of 7 days from the date of booking, if payment is not received to the satisfaction of Orient Express Pvt Ltd., the said booking will automatically be cancelled All prices mentioned/communicated are as applicable per person (unless otherwise specified) and are quoted in US$ (United States Dollars) Prices are quoted for the travel arrangements of the entire journey and itemized component price shall not be provided. The quoted price is including current taxes applicable in India and its neighboring countries as the case may be. Any increase in taxes or introduction of new taxes or levies which are applicable for the period of travel of the Client will be collected from the Client even if full payment has been made by the Client before such increase in taxes Other exclusions - unless expressly included, any expenditure incurred by you but not limited to the following are excluded from the travel arrangements price e,g. international/domestic airfares, arrival and/or departure taxes, fuel levies in some destinations and surcharges, passport and visa costs, overseas travel/ medical insurance, personal expenditure like alcoholic drinks, laundry, room service, extra meals and gratuities/tips etc. Surcharges - the price of the travel arrangements is subject to applicability of surcharges , if any, and the same shall be payable by the Client. Surcharges may be incurred (without limitation) in connection with; fluctuation in currency exchange rates, increases in product prices, fuel levies, scheduled airfares, hotel and ground transportation charges, departures fees/taxes, entrance fees and any other increases in connection with the Travel arrangement.

Payment

Client may use Credit Card for online bookings and Credit Card or Bank Transfer for offline bookings. Orient Express Pvt Ltd. Relies on Third party payment gateway for online credit card payments. It does undertake any responsibility or liability for, but not limited to, data protection, wrongful charges, exchange rates used, etc during the use of such third party payment gateway used by the Client for making payments. Before making the payments Client must understand that it is doing so at its own risk.

Handover of Documents

Once ORIENT EXPRESS PVT. LTD receives the entire amount of payment in respect of the journey booked, the Client shall be sent via Email a travel kit including final tax invoice, Tour Confirmation Voucher, detailed itinerary listing the services they shall be entitled to on the journey and briefing sheet containing important / emergency contact details for your further use.

Amendments

After the initial booking for a particular journey and related services, if any written request is received from the Client for any amendment; such as change of destination, change of departure date, addition or deletion of services, change in number of passengers or such other change the same will be acknowledged from an authorized person of ORIENT EXPRESS PVT. LTD. In the event the amendments requested for involve further costs the same shall be borne by the Client. Further such requests will be entertained subject to availability and at the sole discretion of ORIENT EXPRESS PVT. LTD.

Cancellations

ORIENT EXPRESS PVT. LTD will accept cancellation requests in writing only via Email. The computation of cost for the purpose of cancellation commences when the Email is received at the ORIENT EXPRESS PVT. LTD office in New Delhi working day within working hours as per Indian Standard Time. Usual working hours of our office are as follows – Monday-Friday – 0930hrs till 1730hrs; Saturday – 0930hrs till 1330hrs. Sunday and Holidays – office remains closed. The following charges are payable by the Client for request of cancellation received: from booking date to 61 days prior to departure date: 25% of the total tour cost ; 60 -31 days prior to departure date: 50% of the total tour cost; 30 days prior to departure date :100% of the total tour cost. Cancellation charges may vary or more stringent charges may apply depending upon the itinerary, structure of the package or ORIENT EXPRESS PVT. LTD Suppliers policy.

Refunds

Refunds (if any) for amendments and / or cancellations will be paid directly to the Client by ORIENT EXPRESS PVT. LTD. It would take at least 30-45 days to process the request for refunds. NO REFUND will be payable in case the Client does not utilize any of the services (e.g., Accommodation, Meals, sightseeing, excursions etc) included in the journey and no such claim shall be entertained in any manner whatsoever.

Liability

As mentioned elsewhere the services of ORIENT EXPRESS PVT. LTD are limited to planning and executing the journey and hence shall not be liable for any death, personal injury, sickness, accident, delay, loss, damage, default, deficiency that may be caused to a Client or any third person resulting from the Client's or third party's use of the products and services of the Service Providers/Suppliers. The Client shall be responsible for the safekeeping of their luggage, valuables or any other property/security carried by them on the journey and ORIENT EXPRESS PVT. LTD accepts no liability of any kind for any loss of luggage, valuables, travel documents, insurance policies or any such property/security of the Client or persons travelling with him, whether caused by act, omission, negligence or otherwise, while undertaking a journey, using the services or arising from any booking.

Force Majeure

ORIENT EXPRESS PVT. LTD cannot be held responsible for circumstances beyond its control and arising out of natural calamities, flood, fire, act of God, war or threat of war, physical unrest, riots, civil disturbances, terrorist activities (threatened or actual), delays, strikes, port or airport closure, technical problems with transport, alteration or cancellation of scheduled travel services, breakdown in facilities, accidents etc. however caused.

Governing Law

These conditions are governed by and are to be construed in accordance with the laws of India and disputes, if any are to be decided under the exclusive jurisdiction of the Courts of Delhi, India only.

Privacy

Any information that ORIENT EXPRESS PVT. LTD obtains from the Client or its representative is necessary for ORIENT EXPRESS PVT. LTD's business purposes or providing the Client with ORIENT EXPRESS PVT. LTD's goods and services, and may be used in answering any queries the Client may have; performing internal administration and operations; developing, improving and marketing the ORIENT EXPRESS PVT. LTD's products and services; and any directly related purposes. ORIENT EXPRESS PVT. LTD will not disclose any personal information to any other party without the consent of the Client except to its Suppliers, Auhorized representatives, a related entity or adviser of ORIENT EXPRESS PVT. LTD or where ORIENT EXPRESS PVT. LTD is otherwise required by law to do so.

Accuracy of Information

The information provided herein have been compiled as accurately as possible and have been checked for accuracy at the time of publication. However, certain facilities mentioned may not be operational on account of local conditions during the actual period of the journey and ORIENT EXPRESS PVT. LTD shall not be responsible it.
